Terms of Service

These Terms of Service ("Terms") are an agreement between you and FieldDraft ("FieldDraft," "we," "us") governing your use of the FieldDraft application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What FieldDraft is — and what it is not

FieldDraft is a documentation tool for industrial equipment inspections (such as API 510 pressure vessel, API 570 piping, API 653 storage tank, and API 576 pressure-relief device inspections). It helps you run checklists, capture photos, record thickness readings, and assemble inspection reports.

FieldDraft is not an inspection service, an engineering service, or a professional advisor. It does not inspect equipment, evaluate fitness for service, or certify compliance with any code or standard. Using the Service does not create any professional or fiduciary relationship between us and you or your clients.

2. You are responsible for your inspections

You represent that you hold the certifications, qualifications, and authorizations required to perform the inspections you document with the Service. You are solely responsible for:

  • the accuracy and completeness of every observation, measurement, conclusion, and recommendation in your inspections and reports;
  • compliance with all applicable codes, standards, and regulations (including API 510, API 570, API 653, API 576, ASME, NBIC, OSHA, and jurisdictional requirements); and
  • all decisions made — or not made — based on information recorded in or produced by the Service.

3. AI-generated content is a draft, not a conclusion

The Service includes optional AI features that can draft photo observations, executive summaries, and recommended repairs. AI-generated content:

  • is produced by third-party artificial-intelligence models and may be inaccurate, incomplete, or misleading;
  • is provided solely as a drafting aid — it is not an inspection finding, an engineering judgment, or a professional recommendation; and
  • must be reviewed, verified, corrected, and approved by you, the inspector of record, before it is included in any report or relied on in any way.

We accept no responsibility for AI-generated content or for any decision, report, or outcome based on it. If you have not reviewed and verified AI output, do not use it.

4. Beta service

The Service is currently offered as an early-access beta. That means:

  • the Service is provided "as is" and may change, be interrupted, or be discontinued at any time;
  • although the Service is designed to work offline and sync your data to the cloud, data loss is possible — you should maintain independent records or backups of any critical inspection data; and
  • the beta is currently free. Paid plans may be introduced later; you will never be charged without first agreeing to pricing.

5. Your account

  • You must provide accurate account information and keep your credentials secure.
  • You are responsible for all activity under your account.
  • During the beta, an invite code is required to create an account. Invite codes are personal — please do not share them.
  • You must be at least 18 years old to use the Service.

6. Your content

You retain ownership of everything you upload to or create in the Service — photos, notes, readings, documents, and reports ("Your Content").

You grant us a limited license to host, store, process, transmit, and display Your Content solely to operate and provide the Service — including sending relevant content to the AI providers described in our Privacy Policy when you choose to use an AI feature.

You are responsible for having the rights and permissions needed for Your Content — including any permission required from your clients or site owners to photograph equipment and upload site information. Any confidentiality obligations you owe your clients remain your responsibility.

7. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose;
  • attempt to access other users' data or probe, disable, or disrupt the Service;
  • upload malicious code;
  • resell or sublicense the Service; or
  • reverse engineer the Service except where permitted by law.

8. Third-party services

The Service relies on third-party providers, including Google Firebase (authentication, database, and file storage), Google Gemini and Anthropic Claude (AI processing), and Resend (email delivery). The Service's availability depends in part on theirs. Our Privacy Policy explains what data each provider processes.

9. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that data will not be lost.

10. Limitation of liability

To the maximum extent permitted by law: (a) we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption; (b) we will not be liable for any inspection outcome, equipment failure, property damage, personal injury, regulatory finding, or other consequence arising from inspections documented with the Service or from AI-generated content; and (c) our total liability for all claims relating to the Service will not exceed the greater of $100 or the amounts you paid us for the Service in the 12 months before the claim arose.

11. Indemnification

You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your inspections and reports, or your breach of these Terms.

12. Termination

You may stop using the Service at any time and may request deletion of your account and data (see the Privacy Policy). We may suspend or terminate accounts that violate these Terms, and we may discontinue the beta. Sections 2, 3, 6, and 9 through 11 survive termination.

13. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will ask you to review and accept the updated Terms in the app before continuing to use the Service. The version and effective date at the top of this page tell you when these Terms last changed.

14. Governing law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules. Any dispute must be brought in the state or federal courts located in Mobile County, Alabama.
